A Safety Data Sheet (also known as an SDS) is a crucial document that outlines a product's properties, hazards, and safety information. These documents used to be called Material Safety Data Sheets (MSDSs). The SDSs in the United States of America are regulated under OSHA through Hazard Communication Standards. These documents are required for any company that distributes, ships, or sells hazardous chemical products. Safety Data Sheets are authored using the United Nations' Globally Harmonized System (GHS) of the Classification and Labeling of chemical products.

Any business that manufactures, imports, distributes, or otherwise use hazardous substances are legally required to have a Safety Data Sheet for each product. Generally manufacturers, importers, and distributors are responsible for ensuring that the SDS is up-to-date and accurate while every workplace that stores or uses these hazardous products are required to keep a Safety Data Sheet on file and available for their employees to reference. Many online distributors, such as Amazon and Walmart, require SDSs before sellers can distribute on their marketplaces and hazardous products being shipped often have the required transportation information present on each document.

Regulations, especially those related to Hazard Communication, are constantly changing and are ever-evolving. In the United States there are four main federal regulatory agencies that can claim jurisdiction over your product. Every Safety Data Sheet is regulated by OSHA but your product's labeling may be different based on what the product is meant to be used for.

If your product is used professionally in a workplace environment then it will be labeled to be aligned with OSHA regulations. Products that are used within the dwelling of someone's home, garage, or shed by a user not using the product for commercial/workplace purposes are labeled in accordance with the Consumer Product Safety Commission (CPSC). Chemicals that mitigate, destroy, repel, or otherwise affect a pest are regulated by the Environmental Protection Agency (EPA) while products that are used on or in the human body are regulated by the Federal Drug Administration (FDA).

OSHA'’'s Hazard Communication Standards provide Safety Data Sheet exemptions for "articles". Per 29 CFR 1910.1200(c) the definition of an article is:
"a manufactured item other than a fluid or particle:
(i) which is formed to a specific shape or design during manufacture;
(ii) which has end use function(s) dependent in whole or in part upon its shape or design during end use; and
(iii) which under normal conditions of use does not release more than very small quantities, e.g., minute or trace amounts of a hazardous chemical, and does not pose a physical hazard or health risk to employees"

The simple example of an article under OSHA is a roll of copper electrical wire. The copper and insulation are: formed to a specific shape, which has an end use function that's dependent upon the design, and does not release more than a very small quantity of any hazardous chemical. As a general rule of thumb: if an employee or professional worker is exposed to hazardous conditions associated with a product's ingredients then the product will require an SDS.

We often see article exemptions in Safety Data Sheets that don't fit the three qualifications listed in the OSHA definition above. Article exemptions are incorrectly used for chemicals and mixtures that pose health or physical hazards which would otherwise warrant an SDS.

Products regulated by the US Food & Drug Administration are exempt from OSHA workplace labeling requirements (29 CFR 1910.1200(b)(5)(iii)) if those products are regulated by the Federal Food, Drug, and Cosmetic Act (21 CFR 301) or the Virus-Serum-Toxin Act of 1913 (21 CFR 151).

Food, drug, and cosmetic products have to follow different regulations for labeling but these products are still legally required to have an appropriate Safety Data Sheet if they pose a chemical hazard to the end-user.

Who regulates SDSs for FDA products? As long as the chemical mixture poses a hazard then OSHA regulates the Safety Data Sheet in accordance with the Hazard Communication Standard (29 CFR 1910.1200).
